On Wednesday Dec. 18, 2024, 23XI Racing and Front Row Motorsports were granted a preliminary injunction in their antitrust lawsuit against the National Association of Stock Car Auto Racing (NASCAR). The teams will be able to race as charters next year, which serve as NASCAR’s version of a franchise, and each be officially sold a third charter from Stewart-Haas Racing (SHR) after their closure in 2024. The next day, NASCAR, as expected, chose to appeal the preliminary injunction initially granted to the teams the day before; however, that request was denied.
According to the Associated Press, NASCAR requested to throw out the antitrust lawsuit against them. Despite being considered in federal court located in Western North Carolina, this request was also denied by U.S. District Judge Kenneth Bell, who took over the case after the first round of arguments were heard in November. This lawsuit now moves on towards a trial, which is scheduled for Monday, Dec. 1, 2025.
